The active role of judge, the right to a fair trial and refusal to make a preliminary reference<\/i><\/p>\n
Romanian Academy, 23rd<\/sup>\u00a0October\u00a0 2013, 14:30<\/b><\/p>\n On this occasion the book \u201cRefuzul instan\u0163elor na\u0163ionale de a trimite \u00eentreb\u0103ri preliminare. Jurispruden\u0163a rom\u00e2neasc\u0103\u201d (<\/i>Refusal of national courts to submit preliminary questions. Romanian case law<\/i>), CH Beck, 2013, will be released.<\/p>\n The debate will be attended by Professor Dr. Simina T\u0103n\u0103sescu, Judge Dragos Calin, Mihai Banu and Professor Dr. Mihai Sandru \u2013 acting as moderator.<\/p>\n The national judge, in his\/her capacity of judge of European law, is able to engage, and sometimes is even under a duty to engage in a dialogue with the Court of Justice of the European Union, dialogue which is carried mainly through the preliminary ruling procedure (provided for in Article\u00a0 267 TFEU). One of the features of this judicial dialogue is (paradoxically or not) the refusal of national court to refer to the Court of Justice for a preliminary ruling.
